Agreement to Terms

Welcome to Tripath. These Terms of Service ("Terms") govern your access to and use of the Tripath mobile application and website (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

Eligibility

To use Tripath, you must:

  • Be at least 16 years of age
  • Have the legal capacity to enter into a binding agreement
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Not be prohibited from using the Service under applicable law

Account Registration and Security

When you create an account with Tripath:

  • You agree to provide accurate, current, and complete information
  • You are responsible for maintaining the confidentiality of your password
  • You are responsible for all activities that occur under your account
  • You must immediately notify us of any unauthorized use of your account
  • We reserve the right to suspend or terminate accounts that violate these Terms

Subscription and Payment

Free Trial

Eligible new users who choose the Monthly plan receive a 7-day introductory trial. If you do not cancel before the trial ends, the Monthly plan renews at $14.99/month. The Annual plan is billed at $129.99/year when purchased.

Subscription Plans

  • Monthly: $14.99/month after the 7-day trial if not canceled
  • Annual: $129.99/year, billed annually
  • Subscriptions automatically renew unless canceled
  • Prices are subject to change with 30 days notice

Payment Processing

Subscriptions are purchased through Apple App Store or Google Play. Your subscription is charged to the store account you use, and billing is handled under that store's terms.

Cancellation

  • You may cancel your subscription at any time through your App Store or Play Store account settings
  • Cancellation takes effect at the end of the current billing period
  • Any refund requests are handled by the store you used to subscribe
  • You will retain access to premium features until the end of your paid period

Using Tripath

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use.

You may NOT:

  • Copy, modify, or create derivative works of the Service
  • Reverse engineer, decompile, or disassemble the app
  • Share your account with others or transfer your subscription
  • Use the Service for any commercial purpose
  • Remove or alter any copyright, trademark, or proprietary notices
  • Use automated systems (bots, scrapers) to access the Service

Your Training Data

The training information and personal details you enter into Tripath remain yours. By using the Service, you give us permission to:

  • Store, process, and display your data so the Service works as intended
  • Back up your data to keep the Service reliable
  • Use de-identified, aggregated information to improve Tripath

We will never share your personal training data with third parties without your explicit consent, except as described in our Privacy Policy.

Medical Disclaimer

IMPORTANT: Read Carefully

  • Tripath provides training guidance for fitness purposes only and is not medical care
  • Always consult with a physician before starting any new exercise program
  • Training plans are not medical prescriptions or one-to-one coaching advice
  • You are responsible for monitoring your own health and fitness levels
  • Stop exercising and seek medical attention if you experience pain, dizziness, or discomfort
  • Triathlon training carries inherent risks of injury
  • We are not liable for any injuries or health issues arising from use of our training plans

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind
  • We do not guarantee that the Service will be uninterrupted, secure, or error-free
  • We are not liable for any indirect, incidental, consequential, or punitive damages
  • Our total liability shall not exceed the amount you paid in the past 12 months
  • We are not responsible for injuries, damages, or losses resulting from use of training plans
  • Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you

Intellectual Property

All content, features, and functionality of the Service, including but not limited to:

  • Text, graphics, logos, icons, images
  • Our software, design, and training-plan content
  • Training methodology and workout structures
  • User interface design
  • Tripath brand name and trademarks

...are owned by Tripath or our licensors and are protected by international copyright, trademark, and other intellectual property laws.

Termination

We reserve the right to suspend or terminate your access to the Service:

  • For violations of these Terms
  • For fraudulent or illegal activities
  • If required by law
  • If we change or discontinue the Service

Upon termination, your right to use the Service will immediately cease, but these Terms will continue to apply to your prior use. If we materially change or discontinue the Service, we will provide notice when reasonably possible.

Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or in-app notification at least 30 days before they take effect. Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms. If you do not agree to the changes, you must cancel your subscription and stop using the Service.

Disputes and Applicable Law

These Terms are governed by the laws that apply to the Tripath entity providing the Service to you, subject to any consumer-protection rights that apply where you live.

If a dispute arises, please contact support@tripathapp.com first so we can try to resolve it informally. If we cannot, the dispute will be handled in the forum required by applicable law.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Tripath regarding the Service and supersede all prior agreements and understandings.
