Agreement to Terms

Welcome to Tripath. These Terms of Service ("Terms") govern your access to and use of the Tripath mobile application and website (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

Eligibility

To use Tripath, you must:

  • Be at least 16 years of age
  • Have the legal capacity to enter into a binding agreement
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Not be prohibited from using the Service under applicable law

Account Registration and Security

When you create an account with Tripath:

  • You agree to provide accurate, current, and complete information
  • You are responsible for maintaining the confidentiality of your password
  • You are responsible for all activities that occur under your account
  • You must immediately notify us of any unauthorized use of your account
  • We reserve the right to suspend or terminate accounts that violate these Terms

Subscription and Payment

Free Trial

New users receive a 7-day free trial. You will not be charged during the trial period. If you do not cancel before the trial ends, you will be automatically charged for the subscription plan you selected.

Subscription Plans

  • Monthly: $14.99/month, billed monthly
  • Annual: $129.99/year, billed annually
  • Subscriptions automatically renew unless canceled
  • Prices are subject to change with 30 days notice

Payment Processing

Payments are processed through Apple App Store or Google Play Store. Your subscription will be charged to your App Store or Play Store account. Billing is handled by Apple/Google according to their respective terms.

Cancellation

  • You may cancel your subscription at any time through your App Store or Play Store account settings
  • Cancellation takes effect at the end of the current billing period
  • No refunds are provided for partial billing periods
  • You will retain access to premium features until the end of your paid period

License to Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use.

You may NOT:

  • Copy, modify, or create derivative works of the Service
  • Reverse engineer, decompile, or disassemble the app
  • Share your account with others or transfer your subscription
  • Use the Service for any commercial purpose
  • Remove or alter any copyright, trademark, or proprietary notices
  • Use automated systems (bots, scrapers) to access the Service

User-Generated Content

The training data and personal information you input into Tripath remains yours. By using the Service, you grant us a license to:

  • Store and process your data to provide the Service
  • Use anonymized, aggregated data to improve our algorithms
  • Back up your data across our secure servers

We will never share your personal training data with third parties without your explicit consent, except as described in our Privacy Policy.

Medical Disclaimer

IMPORTANT: Read Carefully

  • Tripath is not a medical device and should not replace professional medical advice
  • Always consult with a physician before starting any new exercise program
  • Training plans are algorithmic suggestions, not medical prescriptions
  • You are responsible for monitoring your own health and fitness levels
  • Stop exercising and seek medical attention if you experience pain, dizziness, or discomfort
  • Triathlon training carries inherent risks of injury
  • We are not liable for any injuries or health issues arising from use of our training plans

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind
  • We do not guarantee that the Service will be uninterrupted, secure, or error-free
  • We are not liable for any indirect, incidental, consequential, or punitive damages
  • Our total liability shall not exceed the amount you paid in the past 12 months
  • We are not responsible for injuries, damages, or losses resulting from use of training plans
  • Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you

Intellectual Property

All content, features, and functionality of the Service, including but not limited to:

  • Text, graphics, logos, icons, images
  • Software code and algorithms
  • Training plan generation methodology
  • User interface design
  • Tripath brand name and trademarks

...are owned by Tripath or our licensors and are protected by international copyright, trademark, and other intellectual property laws.

Termination

We reserve the right to suspend or terminate your access to the Service:

  • For violations of these Terms
  • For fraudulent or illegal activities
  • If required by law
  • If we discontinue the Service (with 30 days notice and pro-rated refund)

Upon termination, your right to use the Service will immediately cease, but these Terms will continue to apply to your prior use.

Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or in-app notification at least 30 days before they take effect. Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms. If you do not agree to the changes, you must cancel your subscription and stop using the Service.

Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration, except where prohibited by law. You waive any right to participate in class action lawsuits.
